Blue CARD

Introduction

Turkish nationals may request authorization to renounce their citizenship to benefit from another country’s economic, social, and political rights under Article 25 of the Turkish Citizenship Law (Law No. 5901, “TCL”). The civil registrations of persons who were granted permission to renounce Turkish citizenship were closed, and they were solely entitled to the rights granted to foreigners under Turkish law. With the advent of the Blue Card and the passage of the TCL, this practice has changed. The Blue Card is only given to those born in Turkey and relinquishes their citizenship after gaining authorization. A Blue Card is not available to anyone who earned Turkish citizenship by naturalization or other reasons other than birth. There is no time limit on the validity of the Blue Card. The Blue Card’s Eligibility

When Turkish citizens request permission to renounce their citizenship, they are given a renunciation paper and are subsequently considered a foreigner. Their descendants can also use the Blue Card up to the third degree.

The Ministry of Interior may provide a renunciation permit or a renunciation document to anyone who requests authorization to abandon their Turkish citizenship if they meet the following criteria:

a) Having reached the age of majority and have the legal capacity to act.

b) Having gained citizenship in a foreign country or significant indications of doing so.

c) Because of a criminal conviction or military service, you are not wanted.

d) Not being bound by any financial or criminal obligations.

Process Methodology

By providing I a certified copy of the identification document or passport issued by the foreign nation authorities; and ii) a petition regarding the Blue Card request, an application can be filed to any civil registration directorate or Turkish consulates.

Once the prerequisites are completed, the Blue Card holder’s children will apply at any age. However, if the child retains Turkish citizenship, they cannot be enrolled in the Blue Card Holders’ Registry.

Number of Identification (“ID Number”)

The Blue Card Holders Registry assigns identity numbers to those who have registered (“Registry”). The Turkish ID numbers of those who have lost Turkish citizenship by getting a renunciation permit will be preserved the same as the Blue Card ID numbers in the Central Civil Registration System (“MERNS”) database. This, however, does not correlate to the ID number of Turkish nationals.

Notification to the Registry

The General Directorate of Civil Registry is keeping the Registry in an electronic format. Blue Cardholders are required to report all types of occurrences to civil registration offices within the country or representative offices overseas, such as births, marriages, divorces, and changes in residence addresses. The Civil Registry Directorates make modifications to the Registry after receiving notification.

Blue Card Holders’ Rights and Obligations

Except for the rights accorded to Turkish citizens, Blue Cardholders will continue to enjoy the rights granted to Turkish citizens, subject to the regulations relating to national security and public order.

i) military service obligations and rights

ii) the ability to vote and run for public office.

iii) the right to work as a government employee

iv) the ability to enter the nation with exempted cars and household goods;

provided that their acquired social security entitlements be protected.

Blue Cardholders are not allowed to work in primary or permanent government positions. They can, however, work in public institutions and organizations as employees, either temporarily or on a contract basis.

Article 28 of the Turkish Citizenship Law is reserved under the International Labour Law (Law No. 6735). As a result, Blue Cardholders do not require a work permit to work in Turkey.
