Introduction
Turkey has become one of the world’s fastest-growing immigrant destinations as a developing country. According to statistics, almost 422,000 foreigners were awarded residence cards in 2015, up from 163,000 in 2009. This causes dramatically increase in Business Turkey.
The government implemented a comprehensive new immigration law in April 2014, which significantly altered the criteria and procedure for resident permits. New categories of resident permit eligibility have been established in this regard, including for people considering purchasing real estate in Turkey.
This article seeks to provide a general overview of residence permit requirements by focusing on a few of the most prevalent concerns that affect the great majority of foreigners planning to relocate to Turkey.
Requirement for a Resident Permit
If foreigners plan to stay in Turkey for more than six months, they must obtain a residence permit.

For visa-exempt entries, the duration of stay is stated, or
The time limit is 90 days.
Foreigners who plan to stay for less time than the duration mentioned above may apply for a residence permit.
Foreigners are exempt.
The following individuals are exempt from having to apply for a residency permit:
Holders of work permits,
Holders of a Work Permit Exemption Certificate,
Diplomatic and consular mission personnel
(1) and members of diplomats’ or consular officers’ families
Officers of intergovernmental organizations with Turkish representative offices
Resident Permits: What They Are and What They Aren’t
The law provides six different types of residence permits (“RPs”). These are the following:
1. RP in the short term
2. RP in the Family
3. RP on a long-term basis
4. Student Representation
5. RP for Humanitarian Purposes
6. RP for victims of human trafficking
The first three RP types will be covered in this essay because they are the most important in practice.
I. Temporary Residency Permit
The most prevalent type of RP is short-term RP. According to 2015 statistics, short-term RPs account for over half of all RPs issued during the year. The purpose of the applicant’s stay is taken into consideration when granting a short-term RP.
People who are eligible to apply for a short-term RP are listed in the statute. The following are some of the most notable:
a) Residents of Turkey who own residential property
Individuals are visiting Turkey to establish commercial ties or start a business.

e) Scientists visiting to do research

h) Employees who are scheduled to get in-service training.
The short-term RP may be given to all of the people listed above for a maximum of two years at a time.

II. Permit for Family Residency
The Family RP is provided to specific family members of persons who have the right to stay in Turkey to protect family unity. People who have the right to remain in Turkey are legally referred to as “supporting persons” in this regard.
One of the following people can act as a supporter:
Citizens of Turkey,
Holders of a valid RP who have resided in Turkey for at least one year are eligible (2)
Those who have a valid work visa or
Exemption certificate holders who have a valid work permit.
The following people may be eligible for a family RP:
The spouse of the supporter,
Kids of the supporting person/spouse, as well as kids of the supportive person/spouse
The dependent child of the supporting person/spouse
A family Residence Permit can only be given for a maximum of three years at a time. Nonetheless, the duration of a family RP cannot, under any circumstances, surpass the term of the supporting person’s RP.
Until the age of 18, every little kid has the right to an education in pre-schools, elementary schools, middle schools, and high schools.
They must apply for a student RP if they desire to continue their study after the age of 18 unless they remain financially reliant on their parents.
Except for compelling reasons linked to community service, duty, education, or health, holders of a valid family RP should not stay outside of Turkey for more than 180 days in a year. Otherwise, their permissions may be revoked or not renewed for a longer length of time.
III. Long-Term Residence Permit
Foreigners who have lived in Turkey lawfully and continuously for at least eight years can apply for a long-term residence permit. The long-term RP is valid for an indefinite period.
Foreigners have the same rights and status as Turkish citizens under the long-term RP, except:
• Voting rights and the ability to run for public office
• The right to work as a government employee
• The possibility to import automobiles without paying any taxes.
• The duty to serve in the military, as well as the opportunity to do so
• Other laws and regulations put limits (for example, restrictions on the acquisition of real estate in specific zones)
Furthermore, after a long-term RP has been secured, the permit holder is allowed to apply for an unlimited work permit.
Except for compelling reasons relating to community service, duty, education, or health, holders of a valid long-term RP may not stay outside of Turkey for more than one year. Their permits will be revoked if they do not comply.
The Procedure for Making an Application
Application Location
The General Directorate of Immigration Administration of the Ministry of Interior is the competent authority for issuing RPs. Depending on the type of RP being sought, the application will be submitted to either.
Turkish Consulates in the foreigner’s country of citizenship/legal residence, or Turkish Consulates in the foreigner’s home country.
Local Boards of Directors
However, for the time being, the consulates cannot accept permit applications because the technical infrastructure has not been finished, and secondary legislation has not been made available. As a result, until the legal and technical preparations are completed, all permit applications are submitted to local directorates.
Application period
Because the application cannot be submitted from outside of Turkey, for the time being, the foreigner must be in Turkey at the time of submission. The application should ideally be submitted within the visa or visa exemption’s authorized period of stay. It is also possible to submit an application within the first 10 days of the overstay term.
Appointment
To submit the application file to the local directorate, the applicant must first schedule an appointment via the “e-ikamet” online system. The applicant must fill out online registration forms, upload a digital copy of his biometric photo, and select an available appointment date and time. (3) it has been formalized
The system provides information about the costs that must be paid as well as the option of making an immediate credit card payment.
The application procedure is assumed to have begun once the online appointment is made, which precludes visitors from infringing visa requirements until the day of the appointment, even if they stay longer than the term of stay stipulated in their visa or visa exemption.
Due to a large number of applications, the time from the date of the online application and the date of the appointment might occasionally take up to a couple of months in practice, especially in Istanbul.
If the applicant desires to leave Turkey during the waiting time, he must get a document known as a “Residence Permit Application Certificate.” The local directorate issues this certificate, which authorizes foreigners to stay abroad for a maximum of 15 days per departure. The certificate exempts the applicant from obtaining a visa, enabling multiple exits and entries throughout the waiting time.
The Application File’s Submission
To submit the application file, the applicant must appear in person on the scheduled date. A legal representative or a licensed lawyer can also file the application.
Depending on the type of RP and/or the purpose of stay, additional documentation is necessary. The following should generally be included in the application file: (4)

Evidence of financial resources, as well as
Health insurance that is valid.
If any missing or inadequate documentation is discovered, the applicant is alerted and given 30 days to complete the absent or insufficient material.
Evaluation of the application
The application is evaluated, and a decision is made within 90 days. During the assessment process, the applicant may be asked for a second interview. If the application is approved, the General Directorate will issue an RP card, which will be dispatched by courier to the applicant’s residence address in Turkey.
Request for an Extension
Extension applications must be submitted within 60 days of the existing residence permit’s expiration date. The e-ikamet system is also used to start extension applications.
Applicants must complete identical forms and provide similar documents. In contrast to first-time applications, however, an application file is submitted by couriering the required documents to the local directorate. As a result, the applicant is not required to appear at the local directorate. The required documentation must be sent within 5 business days of the date of online registration.
